上周，两名非裔顾客在美国费城一家星巴克等朋友，由于未消费，加上试图借用厕所而被星巴克报警称为“非法侵入”，并随后被逮捕。

The world-famous giant Café chain Starbucks has been having a hard time this past week.
The company announced on Tuesday that a half-day training session on racial tolerance for over 175,000 employees will be held on May 29, when 8,000 company-owned US stores will be closed.
The announcement is seen as a response to a week-long controversial incident that saw two black men being arrested for waiting in a Starbucks Philadelphia store. Starbucks’ CEO Kevin Johnson has already apologized through a statement on Saturday, saying the incident “was nothing but reprehensible.”
“什么都没做”也是错？两名黑人星巴克未点单被警察逮捕
The arrestment for doing nothing ——
美国当地4月12号，一名昵称为Melissa Depino的网友在推特上发布了一则视频，视频中显示，两名非裔顾客在星巴克遭到警察逮捕，而周围的顾客纷纷向警察讨要说法，称两位顾客“什么都没做”。
Melissa配文解释道，他们被捕仅仅是因为在星巴克店内等待朋友，却并未点单。
On April 12, a witness to the incident, screen name Melissa Depino, posted a video online showing the two men being handcuffed and escorted by police out of the Starbucks store, with other customers challenging the arrest, telling the officers, “They did nothing.”
Melissa also explained under the post, “The police were called because these men hadn't ordered anything. They were waiting for a friend to show up, who did as they were taken out in handcuffs for doing nothing.”
根据警方回应，两位顾客在店内并未消费，却一直滞留，还曾问店员借用洗手间。由于星巴克规定，未点单客人无权使用卫生间，店员在多次要求顾客离店遭拒后，果断拨出了911。警方随后接到星巴克连线，称受到非法侵入(trespassing)，于是按照流程出警。

According to the response from the police station released on Saturday, the two black men stayed inside the store without ordering and asked to use the restrooms. Since the restrooms were only meant to be offered to paying customers, an employee refused permission. And the men also ignored requests to leave the premises. Later, the store made a 911 call about the situation.
Philadelphia Police Commissioner Richard Ross said the police made the right response to Starbucks’ initial claim of “trespassing.”
一石激起千层浪，网友纷纷质疑星巴克因种族歧视而小题大作，甚至有网友直接评论道，如果他们是白人，事情还可能发生吗？
However, activists did not agree with the “trespassing” accusation. The video soon sparked claims of racial profiling with some arguing that if the men were white, they wouldn’t have received such treatment.

The video has been retweeted more than 170,000 users, making Starbucks a target of public criticism.
官方道歉无用 星巴克遭遇严重抵制
An apology in vain ——
对于事件引起的巨大争议，星巴克官推在14日表示将对此事作出调查，并于15号作出回应，对两位顾客在星巴克所受到的待遇表示抱歉。
The Starbucks official Twitter account promised to investigate the incident on April 14 and made an apology the day after.
然而，民众对于星巴克的公告并不买账，认为道歉太过于轻描淡写。非裔民众于15号主导开展了星巴克的抗议示威活动。当天，就在事件发生的星巴克门口，一位非裔民众手拿话筒，喊话道：“此地今天暂时歇业，以人民的名义。”
But the public seemed not to be satisfied with the short announcement. Demonstrations and boycotts continued against the café shop.
On Apr 15 at the same store where the two men were arrested, one protestor said, “Today, this space is secure, secured by the people.”
而另外一些示威民众则举着“还不够我们原谅你”、“星巴克应该羞愧”的牌子在门口聚集。之后，还有部分民众进入店里与工作人员直接对峙，要求星巴克解雇当天报警的门店经理，并要求警方解雇当天出警的警员。
Many people carried boards in hands, some reading “Too little too latte” and “Enough Shame on you Starbucks.”
“We want the manager fired from this establishment for racially profiling black people.” said a man with bullhorn, “We want the police officers in the arrest fired as well.”
They later approached the store to confront the employees, singing, “Starbucks Coffee is anti-black.”

面对巨大的舆论压力，星巴克CEO凯文约翰逊(Kevin Johnson)于抗议活动当天晚间正式发布公告道歉，称公司的所作所为“理应受到谴责”，将保证不会再犯。
Facing huge public pressure, Starbucks CEO, Kevin Johnson released a statement on the company’s website saying the incident “was nothing but reprehensible” and “will never happen again.”

星巴克随后发布了“反种族歧视”培训的公告，表示将端正态度，给民众一份满意的回应。
另外，除了星巴克8000家直营店以外，培训材料也将提供给机场和杂货店等总共约6000家授权店的员工。
The training was soon announced, and was seen as an effort to cool tensions. According to the company, the training materials will not only be provided for Starbucks employees, but also sent to non-company workers employed by about 6,000 licensed Starbucks stores in grocery stores and airports.
Based on an estimate by Bloomberg, a half-day shutdown of the 8,000 stores will cost the world’s biggest coffee company roughly 16.7 million US dollars, about 100 million yuan.
中国热议：不消费到底能不能享受服务？
Controversies in China ——
事件在中国社交网络上也持续发酵，并直接上了微博热搜。然而，较之美国民众对种族歧视的关注，中国网友的重点似乎更在于——
排除人种问题，未点单的顾客是否有权滞留在商店内并享受相关服务？
The Starbucks incident also created a stir on China’s social network, topping the China’s Twitter-like Weibo moments as a trending topic.
Despite the discrimination accusation, Chinese audiences also placed a moral question into limelight – Is it acceptable for non-paying customers to enjoy the stores’ conveniences for free, including sitting inside stores, borrowing restrooms and having free water?
许多网友对星巴克客人被逮捕的事例表示“瑟瑟发抖”，称自己也在未消费的前提下“蹭”过商家的各种便利。
甚至有网友提到：如果按照星巴克的做法，中国的监狱一天内就可全部被“非法侵入”者填满。
Some supporters of the black men shared their own experiences, admitting that they also have taken advantage of many stores like McDonald’s and KFC. As commented by a netizen, “If you follow Starbucks’ rules, then Chinese prisons will be stuffed to explosion within a day.”
而另外的人对于这种“以不消费的前提享受商家提供的便利”的行为表示无法接受，称商家没有义务为不消费的顾客产生水电人工费等支出，自己在占用商店座位等朋友时，肯定也会适度消费，或者在受到提醒后及时离开。
Others argued that merchants don’t have the obligation to provide non-paying customers free services which add to operating costs. Buying a cup of water or some chips won’t cost much. Or at least, one should leave the store when being noticed.
然而，这在中国法律以及社会上貌似还是个需要细致定义的问题——
根据《中华人民共和国刑法》第二百四十五条第二款规定，非法侵入住宅罪，是指违背住宅内成员的意愿或无法律依据，进入公民住宅，或进入公民住宅后经要求退出而拒不退出的行为。
也就是说，那些因为在麦当劳借厕所、在肯德基写作业的小伙伴，目前还不在中国警察叔叔需要逮捕的范围之内。
Chinese consumers may be relieved to know that they would not be handcuffed by the police since domestic criminal law only regulates trespassing to “residences,” not “chained coffee shops.”
But China’s Law on Protection of the Rights and Interests of Consumers regulates that “trade between merchants and consumers should be conducted under the principle of mutual willingness, equality, justice and sincerity.”
而我们需要注意的是，《消费者权益保护法》总则第四条规定“经营者与消费者进行交易，应当遵循自愿、平等、公平、诚实信用的原则”。
中国消费者协会投诉与法律事务部王前虎主任也曾表示，这个“自愿”原则是针对双方的——
如果经营者有足够充分的理由，可以拒绝为消费者服务；
而另一方面，经营者不得以任何形式对消费者作出不公平，不合理的规定，经营者行为不得对消费者隐含任何歧视和偏见。
A director of the China Consumers Association, Wang Qianhu, in an interview with the People’s Daily, once commented that “mutual willingness” refers to restrictions on both sides. On one hand, merchants can refuse to provide service with adequate reason; on the other side, consumers should not be mistreated with any discrimination or bias. But the final decision varies according to specific occasions.
To be short, though you may not be arrested for taking merchants’ conveniences in China, merchants still preserve the right to refuse your presence in their stores. Thus, one may be grateful for stores who offer you free services, and it may be better if you leave when stores give notice.
在中国，虽然警察叔叔也许不会因为“非法侵入”而将你逮捕，但在商家拒绝为你提供服务的时候，请秉持“自愿”的原则而及时离开，也请在商家为你提供善意便利的时候抱有一颗感恩的心。
有些时候，双方各退一步，便是海阔天空。
